This Privacy Policy describes how Nxly(“Nxly,” “we,” “us,” or “our”) collects, uses, stores, discloses, and protects information when you access or use Nxly, including our website, mobile application, features, content, and related services (collectively, the “Service”).

Nxly is operated by an independent developer based in California, United States.

By accessing or using Nxly, you agree to this Privacy Policy. If you do not agree with this Privacy Policy, please do not access or use Nxly.

1. Key Points About Our Privacy Practices

Here are a few important points about how Nxly handles privacy:

  • We collect information needed to provide, operate, secure, and improve Nxly.
  • We may collect account information, usage information, device information, purchase information, and content you choose to provide.
  • We do not knowingly collect personal information from children under 13.
  • We do not sell your personal information.
  • We may use trusted third-party service providers to help operate Nxly, such as hosting, analytics, payment processing, authentication, customer support, and app functionality providers.
  • If Nxly includes AI, automated, or content-generation features, information you submit may be processed to provide the requested feature.
  • Nxly does not retain face data as separate biometric identifiers (such as face templates or faceprints). Photos you upload that contain faces may be stored as account content and shared with AI providers only to deliver the features you request. See Section 5 for full details.

2. Information We Collect

We may collect the following categories of information depending on how you use Nxly.

Account Information

If you create an account or log in to Nxly, we may collect information such as:

  • name or username;
  • email address;
  • login credentials or authentication identifiers;
  • profile information you choose to provide;
  • account settings and preferences.

If you sign in through a third-party service, such as Apple, Google, or another login provider, we may receive information from that provider, depending on your settings with that provider.

Content You Provide

Nxly may allow you to upload, submit, create, store, generate, send, or share content, including text, images, files, messages, prompts, responses, or other materials.

We collect the content you choose to provide only when you submit it to Nxly or use features that require processing that content.

You are responsible for the content you provide and should not submit content that you do not have the right to use or share.

App Usage Information

We may collect information about how you use Nxly, such as:

  • features you use;
  • pages or screens you view;
  • buttons or links you interact with;
  • time and date of use;
  • session activity;
  • app performance;
  • crash reports;
  • error logs;
  • preferences and settings.

We use this information to operate, debug, secure, analyze, and improve Nxly.

Device and Technical Information

We may collect device and technical information such as:

  • device type;
  • operating system;
  • browser type;
  • app version;
  • IP address;
  • approximate location based on IP address;
  • language settings;
  • device identifiers;
  • advertising identifiers, if applicable;
  • push notification tokens, if you enable notifications;
  • diagnostic and performance data.

Purchase and Subscription Information

If you purchase a subscription, credits, or paid features, we may receive information related to your purchase, such as:

  • confirmation that you purchased a paid feature;
  • subscription status;
  • purchase history;
  • transaction identifiers;
  • renewal or cancellation status.

Payments may be processed by third-party platforms or payment providers, such as Apple, Google, Stripe, or another provider. We do not receive or store your full payment card information unless a payment provider specifically makes limited billing information available to us.

  • any files or screenshots you send;
  • information needed to respond to your request.

3. How We Use Information

We may use the information we collect to:

  • provide, operate, and maintain Nxly;

  • provide AI, automated, or personalized features, if available;
  • process purchases, subscriptions, and paid features;
  • provide customer support;
  • respond to questions, feedback, and requests;
  • send service-related messages, updates, security alerts, and administrative notices;
  • improve, test, and develop Nxly;
  • analyze usage and performance;
  • detect, prevent, and address fraud, abuse, security incidents, and technical issues;
  • enforce our Terms of Service;
  • comply with legal obligations;
  • protect the rights, privacy, safety, and property of Nxly, users, and others.

4. AI, Automated, or Generated Content Features

Nxly may include AI-assisted, automated, or content-generation features.

If you use these features, the information you submit, including prompts, uploaded content, instructions, or other inputs, may be processed to provide the requested output.

We may use third-party service providers to help process requests and generate outputs. These providers may process your submitted information only as needed to provide services to us, improve safety and reliability, comply with legal obligations, or as otherwise described in their own terms and privacy policies.

You should not submit sensitive personal information, confidential information, or content you do not have permission to use.

AI-generated or automated outputs may be inaccurate, incomplete, or unsuitable for your situation. You are responsible for reviewing and verifying outputs before relying on them.

5. Face Data

Nxly offers features that let you upload photos or capture images with your device camera. When those images contain a human face, Nxly may process face data— information derived from facial features in those images — to provide AI photo and video generation, editing, style transfer, virtual try-on, avatar, and similar features (collectively, “Face Features”).

What Face Data We Collect

When you use Face Features, we may collect and process:

  • photos or images you upload or capture that contain your face or another person’s face;
  • facial features visible in those images, as needed to perform the generation or editing you request.

Nxly does not use face data for facial recognition, identity verification, or advertising.

Face Data Is Not Retained as Biometric Data

Nxly does not retain face data in the form of biometric identifiers, facial geometry maps, face templates, or faceprints. We do not create or maintain a separate database of your facial biometric characteristics for identification, authentication, or tracking.

Face data is processed only as part of the image file you submit and is not stored separately from that image.

Why We Store Images That Contain Faces

While we do not retain standalone biometric face data, photos you upload that may contain faces are stored as part of your account content so we can:

  • complete and deliver the AI generation or editing you requested;
  • display your generation history and saved creations in the app;
  • let you reuse or reference prior uploads where a feature supports it;
  • troubleshoot failed generations and provide customer support when needed;
  • maintain the security and integrity of the Service.

How Long We Store Images That Contain Faces

Images you upload that contain faces are stored for as long as your Nxly account remains active and until you delete the associated content or your account.

If you request account deletion, your images and other account data are scheduled for deletion after a grace period of up to 100 days, unless we must retain certain information for legal, security, fraud prevention, or dispute resolution purposes.

We do not store images containing faces indefinitely. Images are deleted when you delete them, when your account is deleted, or when they are no longer reasonably needed to operate the Service, subject to the retention exceptions above.

Third Parties We Share Face Data With

To provide Face Features, we may share photos (which may contain face data) with the following categories of third-party service providers:

  • Cloud hosting and storage providers (such as Cloudflare) — to securely store and deliver your uploaded images and generated outputs.
  • AI and content-generation providers — to process your images and generate the requested output. Depending on the feature and model you select, this may include providers such as fal.ai, Kling AI, OpenAI, Stability AI, Higgsfield, and other AI model providers integrated into Nxly.

We share face data with these providers only as necessary to perform the specific generation, editing, or transformation you request.

Why We Share Face Data with Third Parties

We share images that may contain face data with third parties solely to:

  • process your uploads and produce the AI-generated photos, videos, or edits you request;
  • operate, maintain, and deliver the Face Features;
  • store and transmit your content securely through our infrastructure.

We do not sell face data. We do not share face data with third parties for their independent advertising or marketing purposes.

Whether Third Parties Store Face Data

Cloud storage providers: Images you upload are stored in our cloud storage (Cloudflare R2) at our direction for the retention period described above. These providers store your files as our data processors and do not use your face data for their own purposes. Files are deleted from storage when we delete them from your account or upon account deletion.

AI processing providers: When we send your images to AI providers for generation, those providers process the images on a transient basis to complete your requested job. These providers are instructed to use your data only to provide services to Nxly. Depending on the provider and feature:

  • most providers process images temporarily and do not retain them beyond what is needed to complete the generation and ensure service reliability and safety;
  • some providers may retain inputs for a limited period for abuse prevention, content moderation, or legal compliance, as described in their own privacy policies.

We do not authorize AI providers to use your face data to train generative models on your likeness without your consent, except where a provider’s standard API terms apply to customer data in a manner consistent with providing the service.

  • You can choose not to upload photos containing faces; Face Features that require facial reference images will not be available without them.
  • You can revoke camera and photo library permissions through your device settings at any time.
  • You may delete your creations and request account deletion by contacting us at support@nxly.app.
  • Only upload photos of yourself or others when you have the right and permission to do so.

6. How We Share Information

We may share information in the following circumstances.

Service Providers

We may share information with trusted third-party service providers that help us operate Nxly, including providers for:

  • hosting and cloud storage;
  • analytics;
  • authentication;
  • app functionality;
  • AI or automated processing;
  • payment processing;
  • customer support;
  • email delivery;
  • security and fraud prevention;
  • crash reporting and diagnostics;
  • database management.

These providers may use information only as needed to provide services to us or as permitted by their agreements with us and applicable law.

Payment Platforms

If you purchase paid features, subscriptions, or credits, payment-related information may be processed by third-party payment providers or app stores, such as Apple, Google, Stripe, or another provider.

Your payment may be subject to the privacy policy and terms of the payment provider or app marketplace.

Legal Compliance and Safety

We may disclose information if we believe it is necessary or appropriate to:

  • comply with applicable laws, regulations, legal processes, or government requests;
  • enforce our Terms of Service;
  • protect the rights, privacy, safety, or property of Nxly, users, or others;
  • detect, prevent, or address fraud, abuse, security issues, or technical problems;
  • respond to emergencies.

Business Transfers

If Nxly is involved in a merger, acquisition, financing, reorganization, sale of assets, transfer of service, or similar transaction, information may be transferred as part of that transaction.

With Your Consent

We may share information with your consent or at your direction.

Nxly’s website may use cookies, browser storage, pixels, analytics tools, or similar technologies to:

You can usually adjust your browser settings to reject or remove cookies. Some features may not work properly if cookies or similar technologies are disabled.

If Nxly displays ads or uses advertising-related tools, advertising partners may collect information from your device to help deliver, measure, or improve ads. This may include device identifiers, approximate location, app activity, or similar information.

You may be able to limit ad tracking through your device settings, browser settings, or platform privacy controls.

Nxly does not knowingly collect information for advertising purposes from children under 13.

If you allow push notifications, we may send notifications related to Nxly, including updates, reminders, feature alerts, security notices, or account-related messages.

You can disable push notifications through your device settings.

Nxly will only access these permissions if you allow them through your device settings.

You can revoke permissions at any time through your device settings, but some features may stop working if permissions are disabled.

We retain personal information only for as long as reasonably necessary to provide Nxly, fulfill the purposes described in this Privacy Policy, comply with legal obligations, resolve disputes, enforce agreements, maintain security, and protect our rights.

The length of time we keep information may depend on:

  • the type of information;
  • why we collected it;
  • whether you have an account;
  • whether the information is needed to provide the Service;
  • legal, tax, accounting, security, or compliance requirements.

If you delete your account or request deletion, we will delete or de-identify personal information where required by law, unless we need to keep certain information for legal, security, fraud prevention, dispute resolution, or legitimate business purposes.

Simply uninstalling the app may not automatically delete your account or all information associated with your use of Nxly.

12. Security

We use reasonable technical, administrative, and organizational measures designed to protect information collected through Nxly.

However, no method of transmission or storage is completely secure. We cannot guarantee that information will be completely secure, private, or free from unauthorized access.

You are responsible for keeping your account credentials secure and for limiting access to your device.

13. Your Choices

Depending on where you live and how you use Nxly, you may have choices regarding your information.

Account Information

If Nxly provides account settings, you may be able to update certain account information directly in the app.

Marketing Communications

If we send marketing emails, you may opt out by following the unsubscribe instructions in the email or by contacting us.

You may still receive service-related messages, such as security notices, account messages, or important updates.

14. California Privacy Rights

Nxly does not sell personal information in the traditional sense. If Nxly uses advertising or analytics tools that are considered “sharing” under California law, you may have the right to opt out of that sharing.

Nxly is not directed to children under 13, and children under 13 are not allowed to use Nxly.

Nxly is operated from the United States.
